Labor Watch- While the Administrative Court issued on Sunday the decision to stop the teachers' strike, the union calls for the continuation of the strike.
The decision stipulated that, with reference to Article ‘6/a’ of the Administrative Judiciary Law No. 27 of 2014, the jurisdiction of the Administrative Court as a matter of urgency should meet the conditions set forth in this article: “Considering that the execution of the contested decision results difficult to be rectified and since, while urgent request for an appeal or suit falls within the jurisdiction of the Administrative Court, this request is filed with our court in accordance with administrative case No. '2019/381', hence our court is competent in this view. ''
Furthermore, the text of the resolution concluded: “Since the Summary Court requires the fulfillment of the conditions referred to above, namely, that there is a real danger to the basic rights to be preserved which must be promptly addressed without delay or postponement, and the implementation of the contested decision is encountering difficulties, and that the expedited decision shall not affect the merits of the case. By examining the apparent evidence presented in the application, we find that the conditions of the applicant are present and the court decides to suspend the implementation of the decision to declare the open strike temporarily until further proceedings in the case”.
For his part, Dr. Nasser Al-Nawasrah called on the teachers' union to continue the strike despite the decision of the Administrative Court.
